Postnuptial Agreement

A postnuptial agreement (or “postnup”) performs a similar function, only it is executed after the marriage has begun. This can be especially helpful when financial circumstances evolve: for example, one spouse receives an inheritance, starts or grows a business, or the couple wishes to redefine financial expectations.

Postnups in New York are valid and enforceable, provided they meet essential criteria: a written agreement; signed by both spouses voluntarily and knowingly; full financial disclosure by each spouse; and fair, balanced terms.

Because a postnup modifies financial rights after marriage, the importance of independent legal representation and honest disclosure is especially critical. A well-drafted postnup can protect separate assets, define property classification, clarify maintenance expectations, and help preserve financial peace of mind in changing circumstances.

Prenuptial Agreement

A prenuptial agreement (commonly “prenup”) allows couples to define financial rights and obligations before they tie the knot. Under New York law, a properly drafted prenup, one that is in writing, signed by both parties voluntarily, with full disclosure of assets and debts, is generally enforceable.

With a prenup, you and your future spouse can agree in advance on how to treat: separate property brought into the marriage, real estate, business interests, inheritance, and debt and set expectations for maintenance or support if the marriage ends.

While it may feel pragmatic, a prenup isn’t about planning for divorce, it’s about clarity, transparency, and protecting both parties’ interests so you enter marriage with a shared understanding.
