Uncontested Divorce
An uncontested divorce occurs when both spouses agree on all major terms, including the divorce itself, division of property and debts, any spousal maintenance or support, child custody and visitation, and child support if children are involved. In that scenario, parties can often use the court’s “Uncontested Divorce” paperwork, submit a joint or agreed-upon settlement, and avoid prolonged litigation. Uncontested divorces are generally faster, more cost-effective, and less stressful than contested divorces.
Contested Divorce
By contrast, a contested divorce arises whenever the spouses cannot reach agreement on one or more significant issues, such as custody, property division, spousal support, child support, or even the grounds for divorce itself. In a contested case, the court must step in. That typically involves extensive paperwork, possible hearings or even trial, discovery, and legal argument. Because of the complexity and involvement, contested divorces usually require more time, incur higher costs, and carry greater emotional and procedural stress than uncontested divorces.
